Section 9(2)(b) provides that in the case of a non-selection post, promotions shall be made on the basis of seniority-cum-fitness. In contrast, selection posts are filled on the basis of selection on merit under Section 9(2)(a). The distinction between the two criteria is a frequently tested provision.
